MyHazMate Terms of Use and Disclaimer

These Terms of Use and Disclaimer (“Terms”) apply to your use of the MyHazMate mobile application and any related websites, dashboards, portals, and services we provide (together, the “Service”).
1) Who we are
The Service is operated by:

In these Terms, “we”, “us”, “our” means AI Experts Pty Ltd. “you” means the individual user and/or the business or organisation you represent.
2) Acceptance of these Terms
By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
If you use the Service on behalf of a business or organisation, you confirm you have authority to bind that business to these Terms.
3) Changes to these Terms
We may update these Terms from time to time. The latest version will be available in the app and/or on our website and will apply from the effective date shown.
Your continued use of the Service after updated Terms are available means you accept the updated Terms.
4) What MyHazMate does
MyHazMate helps small and medium businesses:
- create and maintain a hazardous chemicals/materials register; and
- locate, store, and help keep Safety Data Sheets (SDS) current, including by using automated tools (including AI) to read product labels, match products to SDS, and request SDS from suppliers/manufacturers where needed.
5) Important safety and compliance notice (not professional advice)
MyHazMate is not a substitute for professional WHS advice, regulatory guidance, or workplace training.
Hazardous chemicals can cause serious injury, illness, property damage, or death. You are responsible for:
- verifying register entries and SDS match the exact product and formulation used at your workplace;
- ensuring you comply with all applicable WHS laws, regulations, codes of practice, and any industry obligations (which can vary across Australia);
- implementing appropriate controls, procedures, training, storage, labelling, and emergency planning; and
- keeping SDS accessible as required for your workplace.
6) Accounts and team access
You are responsible for:
- maintaining the confidentiality of login details;
- ensuring only authorised users access your business account; and
- all activity performed under your account (including by team members).
You must ensure team members you add have permission to use the Service and upload workplace data/photos.
7) Using AI and automation
The Service uses automated systems (including AI) to assist with tasks such as:
- reading labels from photos, extracting text, and suggesting register fields;
- matching products to SDS and monitoring for newer versions; and
- generating insights (including a potential “risk profile”).
Automation can make mistakes. You must review outputs before relying on them.
We may change, improve, replace, or add AI models and third-party providers over time.
8) Supplier contact and SDS requests (email correspondence)
If the Service cannot locate an SDS online, it may send emails to suppliers/manufacturers (or their listed contacts) requesting an SDS.
You acknowledge and agree that:
- we may send these requests using business/user contact details and relevant product information; and
- we may store copies of emails sent and received, including attachments (such as SDS files) and related metadata, to provide the Service, maintain auditability, and support your account.
9) User content, photos, and data
“Your Content” includes information and materials you upload, enter, or generate through the Service (including photos, register entries, and business details).
You:
- retain ownership of Your Content; and
- grant us a non-exclusive, worldwide, royalty-free licence to host, use, copy, process, and display Your Content only to provide, secure, support, and improve the Service (and as otherwise described in our Privacy Policy).
You promise that:
- you have the rights and permissions needed to upload Your Content; and
- Your Content does not infringe anyone’s rights or break any law.
10) SDS and third-party materials
SDS documents and related content are typically created and owned by third parties (manufacturers/suppliers/publishers) and may be subject to copyright or usage restrictions.
Unless the law allows otherwise, you agree:
- to use SDS obtained via the Service for your internal workplace safety and compliance purposes; and
- not to resell, republish, or commercially exploit third-party SDS content outside your organisation.
11) Emergency QR code feature
If you generate a QR code/link for emergency access:
- anyone with access to the QR code or link may be able to view the information you make available through it; and
- you are responsible for where it is displayed, who can access it, and whether any access controls you choose are appropriate for your workplace.
12) Subscriptions, billing, and renewals
MyHazMate may be offered via paid subscription, including free trials or promotional pricing.
Apple App Store / Google Play
If you subscribe through iOS or Android:
- payments and renewals are processed by Apple App Store and/or Google Play (as applicable);
- your subscription is subject to the relevant store’s billing terms; and
- you manage cancellations and renewals through your Apple/Google account settings.
RevenueCat
We use RevenueCat to help manage subscription entitlements and status across devices.
Price and plan changes
We may change subscription plans, features, and pricing from time to time. Where required by the app store rules, you may be asked to accept changes (for example, price increases) through the store.
Refunds
Refunds (if any) are handled according to the applicable app store’s policies. We do not control store refund decisions.
13) Acceptable use
You must not:
- use the Service unlawfully or to breach workplace policies/laws;
- upload malicious code, attempt unauthorised access, or interfere with the Service;
- reverse engineer or attempt to extract source code except where permitted by law;
- misuse the supplier-email feature (including sending abusive, false, or excessive requests); or
- use the Service in a way that could damage our systems or reputation.
We may suspend or terminate access if we reasonably believe you have breached these Terms.
14) Availability, changes, and support
We aim to keep the Service available, but we do not guarantee uninterrupted access. The Service may be affected by maintenance, updates, outages, or factors outside our control.
We may modify, suspend, or discontinue any part of the Service at any time.
Support may be provided via in-app tools, email, or other channels we choose.
15) Disclaimer (accuracy, suitability, and outcomes)
To the maximum extent permitted by law:
- we do not guarantee that register entries, SDS matching, SDS currency, or AI-extracted information will be complete, accurate, or suitable for your purpose;
- we do not guarantee that the Service will identify every hazardous substance or compliance obligation; and
- you use the Service at your own risk.
You are solely responsible for confirming that:
- the hazardous materials register is correct for your workplace; and
- the SDS stored/linked is the correct SDS for the specific product (including the correct formulation and supplier).
16) Limitation of liability
To the maximum extent permitted by law, we are not liable for any loss or damage (including indirect or consequential loss, loss of profit, loss of revenue, loss of data, business interruption, or reputational loss) arising from or connected with:
- your use of (or inability to use) the Service;
- reliance on any information generated, suggested, or retrieved by the Service (including AI outputs and SDS matching);
- errors or omissions in register content or SDS content (including third-party content);
- supplier non-response or delay; or
- unauthorised access to your account where you have not taken reasonable security steps.
Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees or rights under the Australian Consumer Law or other laws that cannot be excluded.
Where we are permitted to limit our liability for a failure to comply with a non-excludable guarantee, our liability is limited (at our option) to:
- supplying the services again; or
- paying the cost of having the services supplied again.
17) Indemnity
You agree to indemnify us for any loss, damage, or claim arising from:
- your breach of these Terms;
- your misuse of the Service; or
- Your Content, including claims that it infringes rights or is unlawful.
18) Termination
You may stop using the Service at any time. You can cancel subscriptions through the relevant app store.
We may suspend or terminate your access if you breach these Terms or if we reasonably consider it necessary to protect the Service, our users, or third parties.
Termination does not affect:
- accrued payment obligations; or
- rights and obligations intended to survive termination (e.g., liability limits, indemnities, IP, and dispute clauses).
19) Privacy
Our collection and handling of personal information is described in our Privacy Policy (available in-app and/or on our website). By using the Service, you consent to those practices.
20) Intellectual property
We own (or license) all intellectual property in the Service (including the app, branding, features, and documentation), excluding Your Content and third-party content such as SDS.
You receive a limited, revocable, non-transferable licence to use the Service for your internal business purposes during your subscription/authorised access period.
21) Governing law and jurisdiction
These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the courts that can hear appeals from those courts.
